open contract : one that at the date of the contract is very general and indeterminate in terms of the quantity or number or value of the thing or things that are to be given by one side of the contract to the other, such as a last will and testament of a decedent at which he has willed that one-third or less of his estate be inherited by another upon his death, the size and value of his estate being uncertain at the date that he signed his will
